3. What is the law on data collection and protection?

In specific situations, we may collect and process your data with your consent. For instance, when you are asked to tick a box to confirm you are happy to receive details of our latest offers and new product arrivals.

Contractual Obligations

In certain circumstances, we need your personal data to comply with our contractual obligations. For instance, when you place an order for home delivery, we will collect your address details and forward to our courier or postal service for delivery.

If the law requires us to, we may have to forward details of those that are involved in fraud or other criminal activity affecting Curated Living to law enforcement.

4. When and how do we collect your personal data?

  • When you create an account with Curated Living online.

  • When you engage with us on social media.

  • When you purchase a product from our stand at an event where we are exhibiting.

  • When you enter prize draws or competitions.

  • When you book to attend a Curated Living event or workshop.

  • When you choose to complete any surveys we send you.

  • When you comment on or review our products online.

  • When you fill in any forms. For instance, if you have an accident in store, Curated Living may collect your personal data.

  • When you’ve given a third party permission to share with us the information they hold about you.

5. What kind of personal data do we collect?

  • If you create an account on the Curated Living website, we will collect your name, billing / delivery address, orders and receipts, email and telephone number. For your security, we will also keep an encrypted record of your login password.

  • Details of your shopping preferences. For instance, which products you have purchased.

  • Details of your visits to our website and which site you were referred from to ours.

  • Information gathered by the use of cookies in your web browser. See our Cookies Policy below.

  • Payment card information.

  • Your comments and product reviews.

  • Your social media username, if you interact with us through those channels, to help us respond to your comments, questions or feedback.

6. Why do we use your personal data?

Here at Curated Living we would like to get to know our customers in order for us to give you the best possible experience. We use information about you in a number of ways, including collating the information we hold about you to offer you promotions and products, and to invite you to events, that are most likely of interest to you. The data privacy law allows this as part of our legitimate interest in understanding our customers and providing the highest levels of service.

If you do choose not to share personal data with us, or refuse certain contact permissions, we might not be able to provide the service you have requested.

7. How do we use your personal data?

To process any orders that you make online or in store.

If we do not collect your personal data during checkout, we will not be able to process your order and comply with our legal obligations. For instance, your details may be passed to a third party to deliver the product you ordered and we may keep your details for a reasonable period afterwards in order to fulfill any contractual obligations such as refunds and returns.

To respond to your queries, refund requests and complaints.

Handling the information you sent enables us to respond. We may also keep a record of this communications with us to demonstrate how we communicated with you throughout. We do this on the basis of our contractual obligations and our legitimate interests in providing you with the best service and understanding how we can improve our service based on your experience.

To protect our business and your account from fraud and other illegal activities.

This includes using your personal data to maintain, update and safeguard your account. We will also monitor your browsing activity with us to quickly identify and resolve any problems and protect the integrity of the Curated Living website. We will do all this as part of our legitimate interest. For instance, by checking your password (if you have an account) when you login and using automated monitoring of IP addresses to identify possible fraudulent log-ins from unexpected locations.

To process payments and to prevent fraudulent transactions.

We do this on the basis of our legitimate company interests. This also helps to protect our customers from fraud. If we discover any criminal activity or alleged criminal activity through our use of fraud monitoring and suspicious transaction monitoring, we will process this data for the purposes of preventing or detecting unlawful acts. We aim to protect the individuals we interact with from criminal activities.

To send you relevant personalised communications.

With your consent, we will use your personal data, preferences and details of your transactions to keep you informed by email, web, text, telephone about relevant products and services including tailored special offers, discounts, promotions, events, competitions and more.

To send you communications required by law or which are necessary to inform you about our changes to the services we provide you.

For instance, updates to this Privacy Notice, product recall notices, and legally required information relating to your orders. These communications will not include any promotional content and do not require prior consent when sent by email or text message. If we do not use your personal data for these purposes, we would be unable to comply with our legal obligations.

To display the most interesting content to you on our website.

By using the data we hold about your favourite products and brands. We do so on the basis of your consent for our website to place cookies or similar technology on your device. For instance, we may display a list of items you have recently looked at, or offer you recommendations based on your purchase history and any other data you have shared with us.

To fulfil any prize draws or competitions you enter.

To process your booking for a Curated Living event or workshop.

We may need to share your details with third parties who are providing a service on Curated Living’s behalf.

To comply with our contractual or legal obligations to share data with law enforcement.

For instance, when a court order is submitted to share data with law enforcement agencies or a court of law.

To send you feedback requests to help improve our services.

These messages will not include any promotional content and do not require prior consent when sent by email or text message. We have a legitimate interest to do so as this helps make our products or services more relevant to you.

8. How do we manage your marketing preferences?

At any point in which you interact with us, you may be given the opportunity to opt-in to receive marketing communications. Curated Living will only send you marketing communications where you have given your consent to receive them. To ensure that you are still happy to hear from us, if you have not updated your marketing preferences, we may contact you occasionally to remind you that you can opt-out of receiving marketing communications at any time.

If you have opted-in to receive marketing communications from us you can manage your preferences by accessing your online account at any time.

9. How to opt-out of receiving marketing communications.

We would be sad to see you go but if at any time you would prefer not to hear from us, there are a number of ways you can unsubscribe:-

  • You can click the ‘unsubscribe’ link that we provide in all e-newsletter communication. This will automatically unsubscribe you from our marketing list.

  • If you have created a Curated Living account, you can access this on the homepage with your personal login and password and check the box ‘I would like to opt out of receiving news of exclusive offers and latest product news.

  • You can email the Data Protection Manager at DPM@curatedliving.co.uk and request we remove you from our mailing list.

10. What are your rights and how to access your personal data.

You have the right to:

  • Correct your personal data if it is incorrect, out of date or incomplete.

  • Access the personal data we hold about you, free of charge (in most cases).

  • Withdraw consent at any time (where we have no legitimate overriding interest, or once the purpose for which we obtained the data has come to an end (such as fulfilling a purchase).

  • Ask us to stop sending you direct marketing (either through specific channels, or all channels, such as email or post).

  • Request a copy of any information we hold about you, and also to have the data corrected if it is inaccurate. 11. How do we protect your personal data?

We understand that data security is highly important to our customers as it is to Curated Living. We therefore treat your data with the upmost care and take all appropriate steps to protect it.

We secure access to all transactional areas of the Curated Living website.

Access to your personal data is password-protected.

Access to sensitive data, such as payment card information, is secured by SSL encryption.

We regularly monitor our system for possible vulnerabilities and attacks, and we carry out penetration testing to identify ways to further strengthen security.

12. How long will Curated Living keep your personal data?

Curated Living will keep your personal data for so long as is necessary for the purpose for which it was obtained or where we have a legitimate interest to do so.

Where Curated Living no longer requires your personal information, or you withdraw your consent for us to use your data, it will either be deleted entirely or will be made unidentifiable personally and used for statistical analysis, research purposes or transaction details. All personal data will be removed.

If you have created a Curated Living account or signed up to receive marketing information, such as our e-newsletter, then we will retain your personal data for as long as we have your consent to do so.

When you shop online with Curated Living but use the guest checkout and do not give consent to retain your personal data, then we will only retain your personal information for a reasonable period of time - for a maximum of up to six months - after you have completed your purchase. This retention period is in order to fulfil any contractual obligations such as refunds and guarantees.

If you use the guest checkout but already have a Curated Living account, then your purchase history will automatically be stored to your account and will be stored until you communicate to us that you would like to withdraw your consent. This will only apply if you use the same email address for which you set up your Curated Living account.

13. Who we share your personal data with and why?

Curated Living will need to share your personal data with third parties such as:

  • Courier services, for the fulfillment of purchases from Curated Living.

  • IT companies, that support our website.

  • SEO (Search Engine Optimisation) companies, who help to enhance our position in search engine rankings, such as Google particularly when you are searching for products that Curated Living offer.

  • Direct marketing mail providers, such as Moosend that help us manage our e-newsletter.

  • Payment providers, such as Paypal/Worldpay.

  • Shopify, our ecommerce website host.

In providing these services your personal data will, where applicable, be used by the service provider on our behalf. We will check that all third parties we use will provide sufficient guarantees regarding the confidentiality and security of your personal data. We will have written contracts with them that will provide assurances regarding the protection of your personal information and their compliance with our data security standards and international transfer restrictions.

14. Protecting your data outside the European Economic Area (EEA)

The EEA includes all EU Member countries as well as Iceland, Liechtenstein and Norway. There may be times that we will need to share your personal data with third parties and suppliers outside of the EEA, such as the USA or Australia.

If you are based outside of the UK and place an order with Curated Living, we will transfer your personal data to our processing system in the UK. In order to fulfil your order, process your payment details or provide support services we may then be required to transfer the personal data that we collect from you to third-party data processors in countries that are outside of the EEA.

If we do this, we have procedures in place to ensure your data receives the same protection as if it were being processed inside the EEA. Any transfer of your personal data will follow applicable laws and we will treat the information under the guiding principles of this Privacy Notice.

15. Our Cookies Policy

In order for us to provide you with the best possible website experience, we collect certain basic information on you by placing cookies – small text files – on your computer’s hard drive. These text files collect mostly anonymous data, though some of it is designed to detect browsing patterns and technical information such as your Internet connection, the country and telephone code where your computer is located, the web pages viewed during your visit, the products you have clicked on, and any search terms you entered. These cookies are also designed to allow the website to recognise you on subsequent visits.

16. How we understand your user behaviour

We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behaviour and their devices (in particular device's IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our website). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor we will ever use this information to identify individual users or to match it with further data on an individual user. If you live outside the UK, you have the right to lodge your complaint with the relevant data protection regulator in your country of residence.
